 अनुच्छेद 142 (Article 142) – भारतीय संविधान

अनुच्छेद 142 भारत के संविधान का एक अत्यंत शक्तिशाली और विशेष प्रावधान है, जो भारतीय सर्वोच्च न्यायालय (Supreme Court) को यह अधिकार देता है कि वह न्याय प्रदान करने के लिए कोई भी आदेश, निर्णय या निर्देश दे सकता है, जो न्यायहित में आवश्यक हो।

संविधान की भाषा में (Article 142 (1)):

> "सर्वोच्च न्यायालय को यह अधिकार है कि वह अपने क्षेत्राधिकार के प्रयोग में पूर्ण न्याय करने के लिए ऐसा आदेश या आदेश, निर्देश जारी कर सके जो वह आवश्यक समझे।"

मुख्य विशेषताएँ:

1. सिर्फ सुप्रीम कोर्ट के पास यह शक्ति है।

2. यह अधिकार असाधारण परिस्थितियों में प्रयोग होता है।

3. न्याय दिलाने के लिए यह कानूनों से ऊपर जाकर भी फैसला दे सकता है।

4. यह आदेश संपूर्ण भारत पर लागू होता है।

उदाहरण:

1. अयोध्या केस (2019): सुप्रीम कोर्ट ने विवाद सुलझाने के लिए 5 एकड़ जमीन मुस्लिम पक्ष को देने का आदेश Article 142 के तहत दिया।


2. बीजेपी नेता नवजोत सिंह सिद्धू केस: सजा कम करने का आदेश 142 के तहत दिया गया।

महत्त्व: यह कोर्ट को न्याय के लिए लचीलापन (flexibility) देता है।

जब कानून नाकाफी हो, तो Article 142 न्याय सुनिश्चित करता है।

यह भारत के न्यायिक व्यवस्था की ताकत को दर्शाता है।

Article 142 – Indian Constitution

Article 142 is a very powerful and special provision of the Constitution of India, which empowers the Supreme Court of India to make any order, decision, or direction necessary in the interest of justice.

In the language of the Constitution (Article 142 (1)):

> "The Supreme Court has the power to make such order, decision, or direction as it deems necessary for the purpose of doing complete justice."

Key Features:

1. Only the Supreme Court has this power. 2. This power is exercised in exceptional circumstances. 3. To provide justice, it can even make decisions that transcend the law. 4. This order applies to the whole of India.

Examples:

1. Ayodhya Case (2019): The Supreme Court ordered the granting of 5 acres of land to the Muslim side under Article 142 to resolve the dispute. 2. BJP leader Navjot Singh Sidhu Case: The sentence was commuted under Article 142.

Significance: It gives the court flexibility in administering justice.

Article 142 ensures justice when the law is inadequate. This demonstrates the strength of India's judicial system.
